Using our website and portal

These terms govern the public Fleming Data Group website and the general use of our client portal. You may not misuse either service, interfere with security, attempt unauthorized access, introduce malicious code, or use our content or systems unlawfully.

Portal access is limited to invited and authorized users. You are responsible for safeguarding your account and for promptly telling us if you believe access has been compromised.

Professional and managed services

Fleming Data Group provides consulting, advisory, custom software development, website hosting, process automation, and managed services. A proposal, estimate, demonstration, or website description is informational until the parties sign an order, statement of work, or other agreement.

Scope, fees, payment terms, service levels, support, acceptance, warranties, confidentiality, and termination for paid work are governed by the signed agreement for that work. These website terms do not replace or override it.

Client materials and intellectual property

Clients retain ownership of their data and materials. Fleming Data Group retains ownership of all code, including its tools, methods, software, templates, reusable components, and custom development. The signed agreement grants the client the license needed to use its deliverables. A different ownership arrangement applies only when the parties expressly agree to it in a signed agreement.

Documents, demonstrations, and third parties

Portal documents and demonstrations may contain confidential or customer-specific information. Access does not grant permission to copy, distribute, reverse engineer, or disclose that material beyond the purpose for which access was granted.

The services may link to or integrate with third-party providers. Their services and policies apply to their systems.

Availability and responsibility

We work to keep our public and authorized services available and secure. Specific commitments, remedies, warranties, and allocation of risk belong in the applicable signed agreement and are not created by this website. Applicable rights that cannot legally be limited remain unaffected.
